These Terms and Conditions ("Terms") govern the use of the Flosona software-as-a-service platform ("Flosona", "the Service", "we", "us", "our"). By accessing or using Flosona, you ("Client", "you", "your") agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.
1. Description of Services
Flosona provides a cloud-based platform enabling Clients to manage and automate various business processes. The Services may include:
- Business Process Management
- Scheduling jobs for your customers
- Assigning tasks to your employees
- Managing operational workflows end-to-end
- Payment Management
- Managing customer payments
- Connecting to external payment providers (e.g., Stripe, PayPal, etc.)
- Invoicing
- Generating and sending invoices to your customers
- Financial Reporting: Viewing financial statements and related business insights
- Mail Management
- Managing internal and external business emails
- Email connector capabilities, including integration with third-party email providers
- External Integrations: Flosona may offer integrations with third-party applications, including but not limited to email providers, payment gateways, accounting systems, and other external APIs.
Flosona does not own, operate, or control any external applications or connectors. Flosona is not responsible for the availability, performance, security, accuracy, or functionality of any third-party services.
2. Use of the Service
You agree to:
- Provide accurate and complete information when creating an account
- Maintain the confidentiality of your login credentials
- Ensure your use of the Service complies with all applicable laws and regulations
- Obtain any necessary permissions from your customers, employees, or third parties before using their data within Flosona
- Ensure that your use of external connectors complies with the terms of those third-party providers
- NOT use the Service for any illegal, fraudulent, or unauthorized purpose.
- NOT interfere with or disrupt the integrity or performance of the Service.
Flosona reserves the right to suspend or terminate your access if you violate these Terms.
3. Data and Privacy
3.1 Client Data
You retain ownership of all data you input into Flosona ("Client Data"). You grant Flosona a limited license to store, process, and transmit Client Data solely for the purpose of providing the Service. Flosona will handle personal data in accordance with its Privacy Policy.
3.2 Data Security
Flosona implements reasonable administrative, technical, and physical safeguards to protect Client Data. However, no system is completely secure, and Flosona cannot guarantee absolute security.
3.3 External Connectors
When using external connectors, Client Data may be transmitted to or processed by third-party systems. Flosona does not control and is not responsible for how third-party providers handle, store, or secure your data.
4. Service Availability
Flosona aims to provide continuous, uninterrupted service but does not guarantee:
- 100% uptime
- Error-free operation
- Compatibility with all devices, browsers, or external systems
Scheduled maintenance or unforeseen outages may occur.
5. Fees and Billing
- Certain features of the Service may be subject to fees. All fees, billing cycles, and payment terms will be disclosed to you prior to purchase or subscription.
- All fees are non-refundable unless otherwise stated.
- You authorize Flosona to charge applicable fees using your selected payment method.
- Failure to pay may result in suspension or termination of your account.
- Flosona does not store or control your payment credentials beyond what is necessary to facilitate transactions through third-party payment providers.
6. Invoicing and Financial Information
The Service allows you to generate invoices and view financial statements based on the data you provide. You acknowledge and agree that Flosona does not guarantee the accuracy, completeness, or suitability of financial data or reports generated through the Service. The Service does not provide accounting, tax, or legal advice. You are solely responsible for verifying financial information and complying with applicable accounting and tax obligations.
7. Prohibited Use
You agree not to:
- Use the Service for unlawful activities
- Attempt to reverse engineer, copy, or modify the platform
- Interfere with the security or performance of the Service
- Upload malicious code, viruses, or harmful scripts
- Use the Service to send spam or unauthorized communications
8. Third-Party Services
The Service may integrate with third-party applications. Flosona does not own, operate, or control External Applications and has no responsibility or liability for their availability, performance, security, or content. Your use of External Applications is at your own risk.
9. Intellectual Property
All intellectual property related to the Flosona platform is owned by Flosona. You are granted a limited, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, sell, or lease any part of the Service without Flosona's prior written consent.
10. Termination
Flosona may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or engage in fraudulent or harmful activities. You may terminate your account at any time. Upon termination, your right to use the Service will cease.
11. Limitation of Liability
To the maximum extent permitted by law, Flosona shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Flosona's total liability will not exceed the amount paid by you in the previous 12 months.
12. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Flosona disclaims all warranties to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Flosona from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
14. Changes to Terms
Flosona reserves the right to modify these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by the laws of the United Kingdom. Any disputes shall be resolved exclusively in the courts of the United Kingdom.
